Cat's Paw Employment Discrimination

Employment discrimination cases often involve allegations that a decision to fire someone, was illegally motivated by such things as racial, ethnic or gender bias. In some cases, however, it is obvious that the decision maker had no first hand knowledge about the person who was fired. Judge Posner used the term "cat's paw" to describe the situation where a biased co-worker or supervisor manipulates an unbiased decision maker to fire someone for illegal reasons. DETAILS

discrimination and also prohibits retaliation against a person who complains of illegal discrimination. Miriam Regalado charged her employer, North American Stainless, with sex discrimination. Three weeks later, North American Stainless fired Ms. Regalado's fiancée, Eric Thompson. Mr. Thompson filed a lawsuit alleging that his discharge was retaliation against Ms. Regalado for filing her charge of sex discrimination. DETAILS
