Revised Compounding
Brochure Now Available
Representatives from the Animal Health
Institute (AHI), American Veterinary Distributors Association (AVDA),
and American Veterinary Medical Association (AVMA) have been working
closely over the past year to revise the informational brochure on
veterinary compounding that was originally published in 2005. The
Compounding Brochure working group revised the brochure because since
the last publication date, changes had occurred in the regulatory arena
regarding compounding, and there is a continued need for clarifying
federal rules and differences between FDA-approved and unapproved drugs.
Revisions are now complete.

LEGAL UPDATES
Cat's Paw Employment
Discrimination
Employment discrimination cases often
involve allegations that a decision to fire someone, was illegally
motivated by such things as racial, ethnic or gender bias. In some
cases, however, it is obvious that the decision maker had no first hand
knowledge about
the person who was fired. The decision was based on reports from
supervisors who lacked authority to make an employment termination
decision. Judge Posner used the term "cat's paw" to describe the
situation where a biased co-worker or supervisor manipulates an unbiased
decision maker to fire someone for illegal reasons.

line of products at beauty salons across the United States and through a
network of independent online retailers. In mid-2009, Bioelements
entered into written contracts with several dozen California-based
companies for the online retail sale of its products to the public. The
contracts stated the
retailer "shall not charge less than the Manufacturer's Suggested Retail
Price (MSRP)" when reselling Bioelements product, or the retailer is
"prohibited from charging more or less than the Manufacturer's Suggested
Retail Price (MSRP)."

Third Party Retaliation
Title VII of the Civil Rights Act
prohibits certain kinds of employment
discrimination and also prohibits retaliation against a person who
complains of illegal discrimination. Miriam Regalado charged her
employer, North American Stainless, with sex discrimination. Three weeks
later, North American Stainless fired Ms. Regalado's fiancée, Eric
Thompson. Mr. Thompson filed a lawsuit alleging that his discharge was
retaliation against Ms. Regalado for filing her charge of sex
discrimination.
