Subject:                          State Monitor Update Notification/ Drug Distributor Licensing Requirements

 

This is to notify you of recent changes in the State Monitorä Drug Distributor Licensing Requirements Survey.  All revisions or additions are highlighted in orange for your convenience.  These changes are current as of August 25, 2008.  They are summarized as follows:

 

-          Survey has been extensively updated to reflect recent statutory reorganization in many states.

-          Kentucky requirements change the word “wholesaler” to “manufacturer.”

-          Louisiana controlled substance requirements now include manufacturing and dispensing in addition to distribution.

-          Pennsylvania issued guidance on the agency website stating that out of state businesses without sales representatives that manufacturer or distributes drugs and/or devices may voluntarily register in one of two capacities: fee exempt or with fee to receive standard-issued certification.

-          South Carolina  requirements add manufacturing, production, sale, possession, and dispensing to the actions requiring registration.

-          Texas requirements now exempt manufacturers and third-party logistics firms that distribute their own product from distributor registration.

o        Texas licensing statement requirements have been updated.
