last year despite a struggling economy,” says practice owner Diane
Eigner, VMD, past-president of the AAFP. “I believe that the way our

Second Court Holds NLRB
Recess Appointments Unconstitutional
Labor Relations Board (NLRB) was dealt yet another serious setback when
a second appellate court struck down President Obama’s recess
appointments to the NLRB as unconstitutional. In this case, NLRB v. New
Vista Nursing and Rehabilitation, the 3rd Circuit Court of Appeals held
that the recess appointment of Craig Becker in 2010, as well as the
three appointments made in January of 2012, was invalid. The
repercussions of this decision for the Board, and for the businesses
over which it has jurisdiction, will be felt for many months to come.
